The job

Benefits and terms

A starting point, not legal advice. Have a lawyer or HR advisor review contracts with termination or non-compete terms.

What a good offer letter includes

A clear offer letter avoids misunderstandings on day one. It should state the job title, start date, pay and how often it is paid, hours, location, who the person reports to, vacation, probation and any conditions, plus a date to accept by.

This generator fills in the basic vacation and probation rules from your province's employment standards law. Contracts can give more than the minimum, never less.

Things to have a lawyer review

  • Termination clauses that limit notice to the legal minimum (courts read these strictly).
  • Non-compete and non-solicitation clauses (Ontario bans most non-competes).
  • Commission plans, stock options and relocation terms.

Questions people ask

Is this offer letter legally binding?

Once signed by both sides it is an agreement, so make sure it says what you mean. It is a starting point, not legal advice.

What is the minimum vacation in Canada?

Most provinces give 2 weeks (4% vacation pay) after a year, rising to 3 weeks (6%) after 5 years in Ontario, Alberta, B.C. and others. Saskatchewan starts at 3 weeks.

How long can a probation period be?

Employment standards set the period during which no notice is owed (for example 3 months in Ontario, 90 days in Alberta). A contract can set a probation period, but it does not remove other rights.
